Alaska — AS 14.03.110 and AS 14.03.115
Two sections of AS 14.03 (Public Schools Generally) that touch student information:
- AS 14.03.110. A school may not administer a questionnaire or survey that inquires into a student's "personal or private family affairs" without written permission from the parent or legal guardian. The section also sets notice and review rights, and lets the student or parent refuse.
- AS 14.03.115. A school district must provide a copy of a child's record on request of a parent, foster parent or guardian.
The earlier of the two, AS 14.03.110, was added by ch. 23 SLA 1979 (HB 98), approved by the Governor on 24 April 1979 and in effect from 25 April 1979; AS 14.03.115 followed in ch. 36 SLA 1999 (CSSB 27), effective 30 August 1999, and ch. 63 SLA 1999 later added AS 14.03.110's notice and review subsections. Both sections bind the school or district, not a vendor. Alaska has no student-data-privacy statute (see the research note).
Applicability to EdTech
- Surveys delivered in a school. A product that delivers questionnaires to students in a school is read against AS 14.03.110. A district, principal or teacher "may not administer or permit to be administered in a school a questionnaire or survey, whether anonymous or not, that inquires into personal or private family affairs of the student" without written parental permission (AS 14.03.110(a)).
- "Questionnaire or survey" is defined broadly. It means "a list of questions to, or information collected from, a class or group of students" (AS 14.03.110(f)).
- Timing differs for anonymous and named surveys. For an anonymous survey, permission may be obtained annually, with at least two weeks' notice ((b)). For a non-anonymous survey, permission must be obtained at least two weeks before it is given ((c)). In both cases the parent gets a chance to review the survey and written notice of how it will be administered, how the results will be used, and who will have access ((d)).
- Parents may request a copy of the child's record. The district must provide it (AS 14.03.115). Records a vendor holds for a district may be needed to answer such a request.
