Poland — Prawo oświatowe (art. 44a, 108a, 125a)
The Act of 14 December 2016 — Prawo oświatowe is Poland's framework education act. Curated here are its technology-facing provisions: the ministry's education platform (art. 44a), CCTV monitoring in schools (art. 108a) and the remote-learning regime (art. 125a).

Applicability to EdTech
- The state platform (Zintegrowana Platforma Edukacyjna) is statutory: the minister provides schools an information tool with named security duties (access protection, integrity, accountability — art. 44a ust. 1); directors issue logins to pupils, parents and teachers (ust. 2–3); the statute enumerates exactly which pupil and teacher data the tool processes — including live image and voice in audiovisual transmission and pupil-created content (ust. 7), fed from the SIO under art. 60a of the SIO act (ust. 8). The former Portal Edukacji i Nauki (art. 44b–44d) is repealed in the current consolidation.
- Remote learning is a statutory duty, not an option: when classes are suspended for more than two days (safety, temperature, epidemiological threat, other extraordinary events — art. 125a ust. 1), the school must organise "zajęcia z wykorzystaniem metod i technik kształcenia na odległość" from the third day (art. 125a ust. 2). Permitted channels are the art. 44a tool or any electronic-communication means linking teacher, pupil and parent — the slot a third-party platform fills (art. 125a ust. 3).
- The school statute governs the tooling: each school's statut must set the detailed organisation of remote classes, including which information-and-communication technologies teachers use, safe-participation conditions, screen-time alternation, and how attendance is confirmed "z poszanowaniem sfery prywatności ucznia" and the pupil's hardware/software constraints (art. 125a ust. 7) — privacy-respecting attendance checks are a statutory design requirement for platforms.
- CCTV has hard limits: monitoring may not cover classrooms and other listed spaces except under strict conditions (art. 108a ust. 3); recordings are purpose-bound with maximum three-month retention (art. 108a ust. 4) and destruction after (ust. 5); 14-day advance information, written notice to staff, visible signage (ust. 6–8); it must not become staff-performance surveillance (ust. 2).

Scope note: pupil-data processing sits mostly in the System Informacji Oświatowej act and executive ordinances, and graduate-career monitoring in art. 26b — add them when a Poland deployment question needs that level.
Key obligations at a glance
- Remote classes mandatory from day 3 of any suspension longer than two days (art. 125a ust. 2); opting out needs the organ prowadzący's consent and a positive supervisory opinion (ust. 5).
- School statute must name the ICT used and privacy-respecting attendance confirmation (ust. 7).
