Poland — Prawo komunikacji elektronicznej (art. 398–400)
The Act of 12 July 2024 — Prawo komunikacji elektronicznej replaced Prawo telekomunikacyjne and carries Poland's ePrivacy transposition. Curated here are the provisions every online EdTech product touches: unsolicited electronic marketing (art. 398), the cookie rule (art. 399) and the consent standard (art. 400).

Applicability to EdTech
- The cookie rule: storing information or accessing information already stored on a subscriber's or end-user's terminal equipment requires prior clear information (purpose; how to control it via software settings) and consent, and must not change the device's configuration (art. 399 ust. 1); consent may be expressed via software settings or service configuration (ust. 2). Strictly-necessary exemptions mirror ePrivacy: transmission, or a service explicitly requested by the user (ust. 3) — an analytics or tracking cookie in a learning platform needs consent; a session/login cookie does not.
- Installing software on user devices (e.g. an agent or app component) carries its own information-and-consent conditions, including telling the user how to remove it (art. 399 ust. 4).
- Marketing e-mail/telephony needs prior consent: using automatic calling systems or terminal equipment to send commercial information, including direct marketing, is prohibited without prior consent (art. 398 ust. 1); doing it anyway is an act of unfair competition (ust. 4).
- Consent standard = GDPR: obtaining consent follows the data-protection rules (art. 400) — freely given, specific, informed, withdrawable.
