South Korea — Network Act, Art. 50 (commercial advertising messages)
The Act on Promotion of Information and Communications Network Utilization and Information Protection. Its privacy chapter moved into PIPA in 2020; what remains relevant to us is the opt-in regime for commercial electronic messages — Korea's ePrivacy-marketing sibling.
Statute text is Korean (the authentic language); this README is curation.
Applicability to EdTech
- Prior express consent (opt-in) for transmitting commercial advertising information by electronic means (제50조 제1항), with a soft opt-in for existing customers of the same goods/services within statutory limits, night-time restrictions (제3항), mandatory sender identification and easy refusal, and a ban on burdening the recipient with refusal costs.
- For us this governs marketing e-mail/SMS to Korean teachers and schools; transactional service messages are outside "advertising information".
