Italy — AGID Linee guida sull'accessibilità degli strumenti informatici
These are the technical rules that Italy's ICT-accessibility act, the Legge Stanca (legge 4/2004), delegates to the Agenzia per l'Italia Digitale (AGID). Art. 11 of the act requires AGID to issue linee guida setting the technical requirements, the verification methods, the model accessibility statement, the monitoring method and the cases of disproportionate burden (1.2). Art. 4 of the act makes those requirements "necessari" whenever a public body, a school included, buys ICT goods or services (Legge Stanca art. 4). The requirements themselves are references into the harmonised standard EN 301 549 (UNI CEI EN 301549). The version carried is the one for public administrations, dated 21/12/2022.
Fact text is Italian (authentic language); this README is curation.
Applicability to EdTech
- Who is bound (1.4): the soggetti erogatori of art. 3 of the act. These are public administrations, with schools among them, but the list also includes "aziende appaltatrici di servizi informatici" and everyone receiving public contributions to deliver services through information systems. A supplier delivering ICT services to a school is within the act's list, and its products are bought against these requirements.
- Hardware (2.1): hardware (desktops, peripherals, mobile devices) must meet EN 301 549 clause 8, and where relevant clauses 5 (generic), 6 (two-way voice), 7 (video) and 13. The stated purpose is buying solutions "nativamente predisposte all'accessibilità".
- Software and apps (2.4, 2.5): software is held to EN 301 549 clause 11, plus clauses 5, 6, 7 and 13 where relevant; mobile apps to the requirements of Table A.2, from 23 June 2021. Content found only on mobile devices or apps developed for closed groups of users, or for specific use in particular contexts, is exempt (art. 3 comma 2 of the act).
- Web (2.2): WCAG 2.1 level AA, which is equivalent to EN 301 549 clauses 9.1–9.4 and 9.6, is the minimum for every website from 23 September 2020.
- Documentation (2.6): documentation supplied with an ICT product must list and explain how to use its accessibility and compatibility features (EN 301 549 clause 12).
- Disproportionate burden is narrow (6.1, 6.2): it is limited to the four statutory grounds and applied under a strict necessity test. Development time, the need to gather information and the low priority of accessibility work are not, in themselves, legitimate reasons. Where a burden is claimed, the accessibility statement must give the reasons and the accessible alternatives (6.3).
- Complaints (7.3, 7.4): anyone can report accessibility defects through the provider's feedback link. If there is no satisfactory answer within thirty days, the user can go to the Difensore Civico per il Digitale, who can order corrective measures.
