Spain — LOPDGDD (Ley Orgánica 3/2018)
Spain's GDPR implementation act, notable for its Título X "derechos digitales" — including education-specific digital-rights provisions no other Member State has.
Statute text is Spanish (the authentic language); this README is curation.
Applicability to EdTech
- Digital-consent age is 14 (artículo 7): a minor's own consent is valid from 14; under 14 requires holders of patria potestad/tutela, with the scope those holders determine (7.2).
- Schools publishing student data (artículo 92): centros educativos (and anyone running activities with minors) must protect the child's best interest when publishing/disseminating their data via information-society services, and publication via social networks or equivalent services needs art. 7 consent — directly governs photo/work sharing features used by Spanish schools.
- Public bodies escape fines (artículo 77): public administrations (public schools included) get a declaratory resolution and corrective measures instead of sanctions, with responsibility routed to the acting authority — but private vendors are fully finable; the AEPD is among Europe's most active regulators.
- Derecho a la educación digital (artículo 83): the curriculum must guarantee digital competence including safe/adequate media use — the demand-side hook for digital-citizenship content; parents' duty in artículo 84.

The corpus reproduces selected provisions of Ley Orgánica 3/2018 (LOPDGDD) in the BOE consolidated text.
Spanish intellectual-property law places legal provisions outside its scope.
The BOE's conditions of reuse (boe.es/informacion/aviso_legal, read 2026-10-01) also permit reuse "para fines comerciales y no comerciales", on conditions that bind any reuser. The ones that apply: "Debe citarse la fuente de los documentos objeto de la reutilización, incluyendo en todo caso un enlace a la sede electrónica de la Agencia Estatal Boletín Oficial del Estado"; "en el caso de la legislación consolidada, en cada texto que sea objeto de reutilización deberá indicarse expresamente que se trata de un texto consolidado de carácter meramente informativo"; "Debe mencionarse la fecha de la última actualización de los documentos objeto de la reutilización"; and modifications must be identifiable.
Conditions, and how this corpus meets them:
- Cite the source with a link: Fuente de los datos: Agencia Estatal Boletín Oficial del Estado (boe.es); the fact document names the BOE consolidated text in its opening citation line and Meta.
- Say that the consolidated text is informative only: the text reproduced is a texto consolidado de carácter meramente informativo; only the text published in the BOE is authentic.
- Give the date of last update: the BOE "Última actualización" date, 27/12/2025, is pinned in Meta.
- Identify modifications: the provision text is unchanged; the selection of provisions, the Markdown layout and the added anchors are described in Meta.
- Do not suggest official status or BOE sponsorship: the corpus claims neither.
No copyright condition attaches to the statute text itself, because artículo 13 leaves no copyright in it; the BOE's reuse conditions are met as listed above.
