Sachsen — Schuldatenschutz (SächsSchulG §§ 38b, 50a, 63a, 63b)
The digital-education and data provisions of the Sächsisches Schulgesetz: the E-Learning basis (§ 38b), child-protection and parent-information powers (§ 50a), the central Schuldatenschutz norm (§ 63a) and school statistics (§ 63b). Applicability to EdTech
- Sachsen has the leanest statute of the Länder covered so far: § 63a simply points school data protection at the GDPR plus the Sächsisches Datenschutzdurchführungsgesetz and delegates the detail to an ordinance power of the oberste Schulaufsichtsbehörde (§ 63a(1)). A vendor assessment in Sachsen therefore runs mostly on the GDPR itself plus the administrative layer, not on a rich statutory catalogue.
- The operational layer is the VwV Schuldatenschutz, the Kultusministerium's administrative regulation with the actual data catalogues for schools (not extracted — see scope note); the Land's LernSax platform operates under that regime.
- E-Learning has an express but conditioned basis: teaching "über elektronische Medien und mittels Lern- und Kommunikationsplattformen" is allowed at all school types, zeitweilig (temporarily) and only "bei Vorlage eines von der Schulkonferenz beschlossenen pädagogischen Konzeptes", with named use cases — long-term illness, travelling families, talent development, special educational needs (§ 38b). This is narrower than the BW/NRW/SH platform clauses: routine platform use rests on § 63a's general regime rather than a dedicated processing basis.
- Careers-service transfers need consent: passing pupils' names and addresses to the Agentur für Arbeit, Jobcenter or Jugendhilfe requires Art. 6(1)(a)/Art. 7 consent (parents' consent for minors) (§ 63a(2)).
- Statistics: annual collections for enumerated purposes with pupil, teacher and organisational data; heads of public schools and Träger of private schools are auskunftspflichtig (§ 63b).

Scope note: the VwV Schuldatenschutz carries Sachsen's operational catalogues (which data, which systems, retention); add it when an SN deployment question needs the catalogue level.
Key obligations at a glance

- Platform-based teaching requires a Schulkonferenz-approved pedagogical concept and is framed as temporary (§ 38b).

Enforcement
Sächsische Datenschutz- und Transparenzbeauftragte (SDTB) supervises the schools; a vendor's own processing answers to the Land DPA of its establishment under BDSG § 40.
