Hessen — Schuldatenschutz (HSchG §§ 83–85)
The data-protection block of the Hessisches Schulgesetz: the central collection-and-processing norm (§ 83), data processing within digital applications (§ 83a), audio/video transmission in Distanzunterricht (§ 83b), research in schools (§ 84) and statistics (§ 85). Applicability to EdTech
- § 83a is the vendor-relevant gate: processing already lawful under § 83(1) may run inside "digitaler Anwendungen" on exactly two routes — the application is vetted and provided by the Kultusministerium (or a body it commissions), or the school introduces it itself and, as controller, guarantees data-protection compliance and processing security (§ 83a(1)). The Land can also declare centrally provided administrative or pedagogical Verfahren mandatory for schools (§ 83a(2)). An EdTech product in Hessen therefore either enters the ministry's vetted catalogue or rides on the individual school's own controller responsibility.
- Videoconferencing is expressly regulated: hybrid lessons may transmit the necessary data of everyone in the classroom (§ 83b(1)); full distance teaching may use video/telephone systems, but image transmission from outside school premises requires consent (§ 83b(2)).
- Broad statutory basis with a duty to supply data: schools may process personal data including Art. 9 special categories of pupils, prospective pupils, parents and staff for the educational mandate; every pupil has a confidential Schülerakte; those affected are obliged to provide the required information (§ 83(1), § 83(4)).
- Evaluation and monitoring without consent is possible where the public interest substantially outweighs the data subjects' interests and the purpose cannot otherwise be achieved — including handing data to third parties commissioned with external evaluation; school-development analysis of individual pupil data runs pseudonymised (§ 83(5)).
- Lesson recordings (for teacher training/quality development) need prior written information and are deleted after at most five years (§ 83(6)).

Scope note: the ordinance under §§ 83(12)/83a(3) (Verordnung über die Verarbeitung personenbezogener Daten in Schulen) carries the operational catalogues; § 10 HSchG (approval of digital Lehrwerke and Lernprogramme) matters for content products but is a curriculum/approval rule, not a data rule — add either when a HE question needs them.
