Baden-Württemberg — Schuldaten und digitale Bildung (SchG BW §§ 113a–116)
The data and digital-education block of the Schulgesetz für Baden-Württemberg: the pupil individual-data record (§ 113a), data-based quality development (§ 114), processor arrangements and school statistics (§ 115), the Land's Digitale Bildungsplattform (§ 115a), digital media in teaching (§ 115b), the all-day-provision statistic (§ 115c), learning-progress diagnostics (§ 115d) and the mandatory school-administration software ASV-BW (§ 116). BW is the fourth-largest German Land by our subscriber base (13 of 150 mapped active subscriptions — see the TODO Germany entry).

Applicability to EdTech
- § 115b is the digital-teaching basis: digital Lehr- und Lernformen are a "üblicher Bestandteil" of classroom teaching, with schools using IT-supported systems for the educational mandate (§ 115b(1)); schools process pupil and teacher data as required, and pupils and teachers are obliged to accept the processing — including Ton-, Bild- und Videodaten — where it is conducive and proportionate to the teaching format (§ 115b(6)). Usable without individual consent, the operationally decisive point (parallel to NRW § 120(5) and NI § 31(5)).
- Adaptive/AI-supported learning has an express gate: "automatisierte, anpassungsfähige Verfahren" for supporting the individual learning path are permitted per the ordinance under § 115b(11) (§ 115b(9)); in Lernverlaufsdiagnostik, automated scoring may feed grades or material school decisions only after review by a teacher (§ 115d(4)).
- Recordings: audio/video recording of digital lessons is generally prohibited, while creating digital Lehr- und Lernprodukte remains permissible (§ 115b(8)); outside that setting, Bild- und Tonaufnahmen for the educational mandate are allowed with fixed deletion deadlines (§ 115(3a)).
- The state platform frames vendor integrations: the Digitale Bildungsplattform is provided by or on behalf of the Kultusministerium (§ 115a(3)); whether a school uses it is decided bindingly by the Gesamtlehrerkonferenz (§ 115a(4)); its ordinance may regulate joint controllership and processing under Art. 26/28 GDPR (§ 115a(6)). Third-party Verfahren can be attached through the platform's Nutzer- und Zugangsverwaltung, with an enumerated attribute set (ids, names, org/learning-group membership, e-mail, date of birth, hashed passwords, logs and cookies) (§ 115(3e)).
- Processor chain is centralised: the Kultusministerium and the Institut für Bildungsanalysen (IBBW) can appoint Art. 28 processors with effect for public and private schools (§ 115(1)); public schools must use the state software ASV-BW (§ 116(1)).
- Data catalogue: § 113a fixes what a school's pupil record may hold — six data classes from Identifizierungsdaten to Verwaltungsdaten with purposes (§ 113a(2)) — plus a career-long pupil ID (§ 113a(3)) and a statistics pseudonym (§ 113a(5)); private schools are covered with limits (§ 113a(10)).
- Fallback: the Landesdatenschutzgesetz applies where the SchG is silent (§ 115(4)).

Scope note: the ordinances the cluster delegates to (Datenverarbeitungsverordnung Schulen, the Bildungsplattform ordinance under § 115a(6), the § 115b(11) ordinance) carry the operational catalogues — add them when a BW deployment question needs that level.
Key obligations at a glance
- Digital teaching tools covered by the express statutory basis with mandatory participation (§ 115b(1), § 115b(6)); digital formats may replace Präsenzunterricht only on the listed legal/factual/organisational grounds (§ 115b(2)).
- Confidentiality of digital lessons: participation limited to the class/learning group and enumerated additional persons (§ 115b(5)); no recordings (§ 115b(8)).
- Quality-development data: IBBW is the GDPR controller for central instruments, schools for their own; deletion when no longer needed — for data under Abs. 3–7 at the latest two years after the end of school attendance, otherwise after ten years (§ 114(8)).
Enforcement
Der Landesbeauftragte für den Datenschutz und die Informationsfreiheit Baden-Württemberg (LfDI BW) supervises the schools; a vendor's own processing answers to the Land DPA of its establishment under BDSG § 40.

Statute text in DATENVERARBEITUNG.md is reproduced verbatim in German from Landesrecht BW (landesrecht-bw.de, the official Land law portal, "Aktuelle Gesamtausgabe") and built/re-verified mechanically by tools/landesrecht-bw/build_bw_schg.py (verify mode; do not hand-edit statute text). The portal is a juris SPA; extraction goes through its JSON API with an anonymous-login handshake documented in the builder. Anchors derive from printed labels ({#p115b-6} = § 115b Abs. 6); the portal has no stable per-provision fragment ids. The stray closing quote mark at the end of § 115b Abs. 12 is present in the source.
