Applicability to EdTech
- Digital-consent age is 15: a child gains capacity to consent to processing in connection with information-society services offered directly to them on turning fifteen (§ 7) — between Poland/Germany (16) and Italy (14).
- Public bodies cannot be fined: the ÚOOÚ must waive administrative punishment for controllers and processors within Art. 83(7) GDPR — i.e. public authorities and public bodies, which includes Czech public schools (§ 62 odst. 5). Vendors face the ordinary GDPR fine scale; the waiver protects the school, not the supplier.
- The offence catalogue simply mirrors GDPR duties (§ 62 odst. 1).
