Schleswig-Holstein — Schuldatenschutz (SchulG SH §§ 4a, 30–32)
The digital-education basis (§ 4a) and the "Datenschutz im Schulwesen" Abschnitt of the Schleswig-Holsteinisches Schulgesetz: the central processing norm with the data catalogue (§ 30), transfers to parents of adult pupils (§ 31) and research in schools (§ 32). SH is the fifth-largest German Land by our subscriber base (12 of 150 mapped active subscriptions — see the TODO Germany entry).

Applicability to EdTech
- Digital tools have an express double basis: schools may use digital media and tools, "insbesondere digitale Lehr- und Lernsysteme und Netzwerke" (§ 4a(1)), and § 30(1) closes with the matching data basis — processing is permitted "soweit dies zur Nutzung digitaler Lehr- und Lernformen im Sinne des § 4a … erforderlich ist", expressly including data that only arises during use (§ 30(1)). Usage/telemetry data of a learning platform is therefore covered by statute, not consent.
- Official-devices rule shapes deployments: automated processing of pupil/parent data is in principle allowed only on officially provided devices and programs that can implement Art. 32 GDPR measures; the ministry regulates exceptions by ordinance (§ 30(2)).
- Centralised processor chain: the education ministry can appoint Art. 28 processors for the schools' administrative or pedagogical processing, with schools remaining controllers and the ministry centrally responsible for the propriety of the automated procedure (§ 30(2a)).
- Data catalogue: § 30(1) enumerates what schools, Schulträger and Schulaufsicht may process about pupils (including health, support-needs and behaviour data where relevant to schooling) and parents; pupils and parents are obliged to supply the required data (§ 30(1)).
- Data-subject rights are trimmed at the edges: access under Art. 15 GDPR can be restricted to protect the pupil, parents or third parties (§ 30(9)); teachers' interim assessments and personal notes are excluded from Art. 12–21 rights altogether (§ 30(10)); research practica may process special-category data with safeguards and restricted rights (§ 32(2)).
- Ordinance layer: § 30(11) delegates the operational detail — including processing by teachers outside school (Nr. 5), automated procedures (Nr. 7) and the technical and organisational measures digital teaching requires (Nr. 11) (§ 30(11)); the LDSG applies subsidiarily (§ 30(12)).

Scope note: the Schulgesetz delegates the operational catalogues to the Schul-Datenschutzverordnung (SchulDSVO SH) — add it when an SH deployment question needs the catalogue level.
Key obligations at a glance

- Digital teaching may replace Präsenzunterricht only in the § 4a(2)/(3) cases, with pupils lacking access to be included by other means (§ 4a(2)).

Enforcement
Unabhängiges Landeszentrum für Datenschutz Schleswig-Holstein (ULD) supervises the schools; a vendor's own processing answers to the Land DPA of its establishment under BDSG § 40.
